This agreement is between you and the developer of Wanedays. Apple distributes the app and processes your payment. Apple is not a party to this agreement and is not responsible for the app.

1. Your licence

We grant you a personal, non transferable, non exclusive licence to use Wanedays on any Apple device that you own or control, as permitted by the App Store Terms of Service. The app itself, its design, its text and its underlying software remain ours. You may not copy, resell, reverse engineer or redistribute it, except where local law gives you a right we cannot exclude.

2. Subscription, trial and renewal

• Wanedays is offered as an annual subscription with a free trial of 21 days.
• The trial is free for its full length. Unless you cancel during it, the subscription begins and your Apple Account is charged the price shown on the purchase sheet at the time you signed up.
• The subscription renews automatically each year at the then current price, and your Apple Account is charged within 24 hours of the end of the period.
• To stop renewal, turn it off at least 24 hours before the period ends, in Settings under your Apple Account, or through apps.apple.com/account/subscriptions.
• Prices vary by country and may change. Apple notifies you before any price increase takes effect and asks for your consent where the law requires it.

Starting a trial and then cancelling before it ends forfeits the remainder of that trial. Apple's rules, not ours.

3. Cancelling and refunds

All purchases run through Apple, so all refunds do too. We cannot issue one, see your payment method or reverse a charge. Request a refund at reportaproblem.apple.com. If you believe something in the app misled you about what you were buying, write to us anyway. We would rather know.

4. What Wanedays is and is not

Wanedays is a tracker and a planner. It records what you tell it and arranges it into a schedule you chose. That is the whole of what it does.

It is not a medical device, a diagnosis, a treatment or a substitute for professional care. It does not assess your health, interpret any reading you enter, or predict any outcome. Nothing it displays is medical advice. Decisions about nicotine, medication and your health belong with you and a qualified clinician. Talk to a doctor or pharmacist before changing how you use nicotine, particularly if you are pregnant, breastfeeding, or being treated for a heart condition or any other illness.

If you are in distress or in a medical emergency, contact emergency services. In the United States, free quitline coaching is available in any state at any time on 1‑800‑QUIT‑NOW.

5. Age

Wanedays concerns nicotine use and is intended for adults aged 18 or over. By using it you confirm that you meet that age.

6. Acceptable use

Use Wanedays for your own reduction. Do not use it to give clinical advice to another person, do not present its output as a medical assessment, and do not attempt to interfere with the app, its widget or the subscription checks.

7. Your data

Everything you log stays on your device. We hold no copy and can neither recover nor restore it. Losing the device, deleting the app or resetting the phone loses the log with it. The privacy policy sets out the detail and forms part of these terms.

8. Availability and support

We are solely responsible for supporting Wanedays. Apple has no obligation to do so. We aim to keep the app working on currently supported versions of iOS, and we may change or withdraw features between releases. Where a change removes something you paid for, you may request a refund through Apple as described in section 3.

9. Warranty disclaimer

Wanedays is provided as is and as available, to the fullest extent the law permits, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non infringement. We do not warrant that the app will be uninterrupted, error free, or that any plan it generates suits your circumstances.

Where local consumer law grants you warranties that cannot be excluded, those apply and nothing here limits them. If the app fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.

10. Limitation of liability

To the fullest extent the law permits, we are not liable for indirect, incidental, special or consequential loss, for lost data, or for any health outcome connected with your use of the app. Our total liability to you is limited to the amount you paid for Wanedays in the twelve months before the claim arose. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

11. Apple's role

• This agreement is between you and us. Apple is not a party to it.
• Apple is not responsible for the app or its content, and has no obligation to furnish maintenance or support.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• If a third party claims the app infringes their intellectual property, we are solely responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a United States Government embargo or designated as a terrorist supporting country, and that you are not on any United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of this agreement and may enforce it against you.

12. Changes and termination

We may update these terms. The effective date at the top changes when we do, and a material change will be announced inside the app before it takes effect. Continuing to use Wanedays after that date means you accept the new terms. You may end this agreement at any time by cancelling your subscription and deleting the app.
